Robert H. Bork, né à Pittsburgh, Pennsylvanie (USA) le 1er mars 1927, est un juriste américain. Il est connu pour ses travaux sur les lois antitrust et sa défense de l'originalisme.
Présentation
Son père, Harry Philip Bork (1897-1974), possédait une société de négoce d'acier et sa mère, Elisabeth Kunkle (1898-2004), était institutrice.
Robert Bork est diplômé en droit de l'Université de Chicago. Il commença sa carrière en tant qu'avocat en 1954 puis devint professeur à la Yale Law School de 1962 à 1975 puis de 1977 à 1981.
Ses écrits ont permis d'infléchir les décisions de la Cour suprême américaine dans le domaine de la loi antitrust depuis les années 1970. En particulier, dans The Antitrust Paradox, il soutient que les fusions d'entreprises servent en premier lieu le consommateur et que les règlementer c'est agir au détriment de ce dernier. Parmi ses étudiants, il eut Bill Clinton et Hillary Rodham, future épouse de Clinton.
Il a également été avocat général des États-Unis (United States Solicitor General). Il fut nommé à la cour suprême par le président Reagan mais sa nomination fut annulée après une longue guerre des tranchées entre républicains et démocrates.
